Contracting the service implies full acceptance of these Terms.
3. Intended users
EcommFinder is a service aimed at businesses and professionals for the development of their economic activity.

All prices are shown excluding VAT. The applicable tax will be added according to the customer’s country and tax status.
Current prices are those published at https://ecommfinder.com/en/plans/ at the time of contracting.
7. €1 trial
Initial sign-up may be done via the €1-plus-VAT trial, governed by a separate document available at https://ecommfinder.com/terminos-prueba-1-euro/, which forms an integral part of these Terms.
Summary: €1 plus VAT is charged, the trial lasts 30 calendar days, a card is required, and unless cancelled beforehand the subscription automatically activates at the plan selected during sign-up.
8. Billing, payment and automatic renewal
- The subscription is billed in advance, on a monthly basis.
- Payment is made by card through a payment service provider. SAASFY SOLUTIONS, S.L. does not store full card details.
- The subscription renews automatically for successive one-month periods unless cancelled beforehand under clause 10.
- An invoice will be issued for each charge and sent to the email address provided by the customer.
- Non-payment: if a charge is declined, up to three retries will be attempted over the following fifteen calendar days. If unsuccessful after that period, the service may be suspended under clause 18, with seven calendar days’ prior notice.
9. Plan changes and usage above the limit
The customer may request a plan change at any time by writing to info@saasfy.es. Upgrades take effect immediately; downgrades take effect in the following period.
Occasional excess over the limit. If, in a given month, request usage exceeds the contracted plan’s limit, the service is not interrupted and no additional charge is applied for that excess. SAASFY SOLUTIONS, S.L. will notify the customer for informational purposes.
Structurally higher usage. SAASFY SOLUTIONS, S.L. will calculate, on a monthly basis, the average requests over the last three full months. When that average exceeds the contracted plan’s limit, the subscription will move to the next plan tier corresponding to that usage.
This plan change will be applied on the following invoice, with the customer notified at that time along with details of the average usage that triggered it.
If the customer disagrees with the change, they may cancel the subscription under clause 10. In that case, they may request a refund of the difference between the previous and new fee for the billed period, by writing to info@saasfy.es within fourteen calendar days of the invoice date.
SAASFY SOLUTIONS, S.L. will notify the customer when their monthly usage reaches 80% of their plan’s limit.
10. Term, cancellation and effects
- The subscription is not subject to a minimum term.
- The customer may cancel at any time by writing to info@saasfy.es, without needing to justify the decision. No specific format or subject line is required; identifying the account or store is sufficient. SAASFY SOLUTIONS, S.L. will confirm cancellation by email.
- Cancellation takes effect at the end of the monthly period already invoiced. The service remains active until that date.
- No refunds are given for amounts corresponding to periods already started, nor for the trial fee, except as provided in clause 9.5.
- After cancellation, the customer’s data and indexed catalog will be retained for thirty calendar days to allow recovery in case of reactivation. After that period they will be permanently deleted.
11. Customer obligations
- Provide truthful information and keep it up to date, in particular billing details and the contact email.
- Safeguard access credentials and be responsible for their use.
- Hold the necessary rights over the catalog, content and data indexed through the Service.
- Not use the Service for unlawful purposes, in a way that degrades its operation or that of third parties, nor reverse-engineer it.
- Comply with applicable regulations regarding their own end users, including data protection law and information society services law.
12. Intellectual and industrial property
The Service, its software, trademarks and documentation are owned by SAASFY SOLUTIONS, S.L. Contracting grants only a non-exclusive, non-transferable right of use limited to the term of the subscription.
The customer’s catalog, content and data remain their exclusive property. Indexing does not transfer any rights over them.
13. Data protection and data processing agreement
13.1. Customer data
Processing of the customer’s personal data in their capacity as account holder, for purposes of contract management, billing and support, is governed by the Privacy Policy published at https://ecommfinder.com/en/privacy-policy/, under which SAASFY SOLUTIONS, S.L. acts as data controller.
13.2. Processor status
To the extent that the provision of the Service involves the processing of personal data of the customer’s end users, the customer acts as data controller and SAASFY SOLUTIONS, S.L. as data processor.
Clauses 13.3 to 13.14 constitute the data processing agreement required under Article 28.3 of Regulation (EU) 2016/679, and bind both parties from the moment the Service is contracted, with no need to sign an additional document.
13.3. Subject matter, nature and purpose
The processing has as its subject matter the provision of the contracted Service and consists of indexing the customer’s catalog and processing search queries made by their end users, for the sole purpose of returning search results, recommendations and related features within the customer’s store.
SAASFY SOLUTIONS, S.L. will not process the data for any purpose of its own other than providing the Service.
13.4. Duration
Processing continues for the entire term of the subscription and for the subsequent retention period set out in clause 10.5, after which the provisions of clause 13.11 will apply.
13.5. Categories of data and data subjects
Data subjects: end users who interact with the search engine on the customer’s store.
Categories of data: search queries entered by the user, technical session identifiers and navigation data associated with interaction with the search engine.
The Service does not require or request special categories of data under Article 9 of the Regulation. The customer undertakes not to include in the indexed catalog any personal data unnecessary for the provision of the Service, and is responsible for the content they choose to index.
13.6. Controller’s instructions
SAASFY SOLUTIONS, S.L. will process the data solely on documented instructions from the customer. These Terms, the configuration the customer sets within the Service, and instructions given in writing to info@saasfy.es are considered documented instructions.
If SAASFY SOLUTIONS, S.L. believes an instruction infringes data protection law, it will notify the customer without delay and may suspend its execution.
13.7. Confidentiality
SAASFY SOLUTIONS, S.L. guarantees that persons authorized to process the data have expressly committed to observing confidentiality, or are subject to an appropriate statutory or contractual duty of confidentiality. This obligation survives termination of the contract.
13.8. Security
SAASFY SOLUTIONS, S.L. will implement appropriate technical and organizational measures in accordance with Article 32 of the Regulation, taking into account the state of the art, implementation costs, and the nature, scope, context and purposes of the processing. These measures include, at a minimum:
- Encryption of communications in transit.
- Need-to-know access control with individual credentials.
- Logical separation of each customer’s data.
- Logging of access and system activity.
- Backups and restoration procedures.
- Periodic review of the effectiveness of these measures.
13.9. Sub-processors
The customer gives general authorization for SAASFY SOLUTIONS, S.L. to engage sub-processors for the provision of the Service, in particular for hosting, AI-based processing and payment services.
SAASFY SOLUTIONS, S.L. maintains an up-to-date list of such sub-processors, which will be made available to the customer upon request to info@saasfy.es, and in any case prior to contracting.
Any addition or replacement of a sub-processor will be communicated to the customer with reasonable notice. The customer may object on justified data-protection grounds and, if the disagreement persists, terminate the subscription without penalty, with a refund of the unused proportional part of the current period.
SAASFY SOLUTIONS, S.L. will impose on each sub-processor, by contract, the same data protection obligations set out in this clause 13, and will be liable to the customer for any breach by them.
13.10. International transfers
The Service’s data is hosted within the European Union.
Certain AI-based features involve the processing of search queries by providers located outside the European Economic Area. Such transfers are safeguarded under the mechanisms set out in Chapter V of the Regulation, by way of an adequacy decision where applicable to the provider concerned, or otherwise by way of standard contractual clauses adopted by the European Commission, supplemented with any additional measures required.
SAASFY SOLUTIONS, S.L. will inform the customer, upon request, of the specific mechanism applicable to each transfer.
13.11. Return or deletion
Once provision of the Service has ended, and after the thirty-calendar-day retention period set out in clause 10.5 has elapsed, SAASFY SOLUTIONS, S.L. will delete the personal data processed on behalf of the customer, along with any existing copies, unless retention is required under European Union or Member State law.
Within that thirty-day period, the customer may request the return of the data in a structured, commonly used format by writing to info@saasfy.es.
13.12. Assistance to the controller
SAASFY SOLUTIONS, S.L. will assist the customer, taking into account the nature of the processing and the information available to it:
- Through appropriate technical and organizational measures, so the customer can respond to data subjects’ requests to exercise their rights. If a data subject addresses their request directly to SAASFY SOLUTIONS, S.L., it will forward it to the customer without delay.
- In complying with the obligations under Articles 32 to 36 of the Regulation, including impact assessments and prior consultation where applicable.
- By notifying the customer, without undue delay after becoming aware of it, of any personal data breach, together with the information available so the customer can meet their own notification obligations.
13.13. Information and audit
SAASFY SOLUTIONS, S.L. will make available to the customer the information necessary to demonstrate compliance with the obligations of this clause 13, and will allow and contribute to audits, including inspections, carried out by the customer or an auditor appointed by them.
Audits will be carried out with reasonable prior notice, during business hours, without disrupting ordinary business activity, subject to confidentiality, and at a maximum frequency of once a year, except where required by a supervisory authority or a security incident affecting the customer.
13.14. Data isolation
Each customer’s data is processed in isolation. SAASFY SOLUTIONS, S.L. does not use one customer’s catalog, queries or data to provide the Service to other customers, nor to train or fine-tune models applied to third parties.
14. Availability, support and maintenance
- SAASFY SOLUTIONS, S.L. will provide the Service with reasonable diligence, using the technical means available to it.
- No formal availability commitment or guaranteed service percentage is offered. The Service is provided on an “as available” basis.
- Maintenance windows may take place. When scheduled, they will be carried out during low-activity hours where possible and communicated in advance.
- Support is provided via info@saasfy.es.
- SAASFY SOLUTIONS, S.L. is not liable for unavailability attributable to the customer’s e-commerce platform, hosting, connection, or third parties outside its control.
15. Liability
- SAASFY SOLUTIONS, S.L. will be liable for direct damages actually caused to the customer as a result of its breach.
- Towards business or professional customers, and except in cases of willful misconduct or gross negligence, aggregate liability shall be limited to the amount of fees actually paid by the customer in the twelve months preceding the event giving rise to the claim. Loss of profit, loss of business and indirect damages are excluded.
- The limitation set out in the preceding point does not apply where the customer qualifies as a consumer, in which case consumer protection law shall apply.
16. Changes to these Terms and to pricing
- SAASFY SOLUTIONS, S.L. may amend these Terms and its pricing, giving the customer at least thirty calendar days’ notice before they take effect.
- If the customer does not accept the change, they may cancel the subscription at no cost before it takes effect. Continued use of the Service after that date constitutes acceptance.
- This clause does not apply to plan changes due to structural usage under clause 9, which are governed by their own rules.
17. Suspension and termination for breach
- SAASFY SOLUTIONS, S.L. may suspend the Service in the event of non-payment after the period set out in clause 8.5, unlawful use of the Service, or a demonstrated risk to platform security.
- Except in cases of urgency or security risk, suspension will be communicated with seven calendar days’ notice, giving the customer the opportunity to remedy the situation.
- A serious and unremedied breach will entitle either party to terminate the contract.
18. Governing law and dispute resolution
- These Terms are governed by Spanish law.
- For business or professional customers, the parties submit to the Courts of Elche (Alicante), expressly waiving any other jurisdiction.
- Where the customer qualifies as a consumer, the courts legally applicable to them shall have jurisdiction, and the submission set out in the preceding point shall not apply. The customer may also refer the matter to the European Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.
